Refund Policy

This Refund Policy explains how GemForge Ltd ("GemForge", "we", "us", or "our") handles refund requests for purchases made through GemForge Labs (the "Platform"). Payments are processed by our authorised payment partner, Paddle. Paddle's Refund Policy also applies to your purchase and, where there is any inconsistency, Paddle's policy will take precedence.
1. General
1.1 Unless required by applicable law, all subscription purchases made through the Platform are non-refundable and non-exchangeable.
1.2 Nothing in this Refund Policy affects any mandatory statutory rights you may have under applicable law. Where local consumer protection laws grant you greater rights, those rights will apply.
1.3 Refunds will not be issued where there is evidence of fraud, refund abuse, or other manipulative behaviour.
2. Statutory Withdrawal Rights
2.1 Consumers in the EU, EEA, Switzerland, and United Kingdom have a 14-day statutory right to withdraw from digital content and service contracts and receive a full refund. This right applies to one-off purchases and to the first payment under a Subscription. It does not apply to subsequent Subscription payments unless otherwise required by law.
2.2 The right to withdraw does not apply where digital content has started to be downloaded, streamed, or otherwise used, and you gave express consent to waive your withdrawal right at the time of purchase.
2.3 Consumers in other jurisdictions may have different statutory rights. Please refer to Paddle's Refund Policy for country-specific rules.
3. Discretionary Refunds
3.1 GemForge and Paddle may, at their discretion, consider a refund request submitted within 14 days of the date of purchase. Submission of a request within this period does not guarantee a refund.
3.2 Refund requests are reviewed on a case-by-case basis. Relevant factors may include the nature of the subscription, the reason for the request, and usage of the Platform during the refund period. A request may be approved in full, approved in part, or declined.
3.3 A discretionary refund does not create any obligation to provide refunds in future, including for similar requests.
4. Subscription Renewals
4.1 Renewal payments are non-refundable once processed, unless otherwise required by applicable law.
4.2 You may cancel your subscription at any time through your account settings to prevent future renewal charges. Cancellation takes effect at the end of the current billing period. Cancellation is not itself a refund request.
4.3 If you cancel your subscription, your access will continue until the end of the current billing period unless otherwise stated at the point of purchase.
5. Duplicate Charges, Billing Errors, and Technical Defects
5.1 If you believe you have been charged incorrectly or without authorisation, please contact us as soon as possible. Verified duplicate charges or billing errors will normally be refunded in full.
5.2 If you experience a persistent technical issue or material defect that prevents access to the Platform as described, please contact us at [email protected]. Where a material defect is confirmed, a refund will be issued in accordance with applicable consumer protection law.
6. Chargebacks
6.1 If you believe a charge was made in error, we encourage you to contact us before raising a chargeback or dispute with your bank or card issuer, as this typically results in faster resolution.
6.2 GemForge and Paddle reserve the right to suspend access to the Platform where a chargeback is initiated, pending review. GemForge reserves the right to terminate accounts associated with fraudulent or abusive chargeback activity.
7. How to Request a Refund
7.1 To request a refund, you may:
- use the "View receipt" or "Manage subscription" link in your purchase confirmation email; or
- contact us at [email protected] with your account email address, date of purchase, amount charged, any transaction or order reference, and a brief explanation of your request.
7.2 GemForge may request additional information reasonably necessary to verify your identity and investigate the request.
7.3 If eligible, refunds will be returned to the original payment method used for the purchase, normally within 14 days of approval. The time taken for refunded funds to appear in your account may vary depending on your payment provider or bank.
8. Changes to This Policy
8.1 We may update this Refund Policy from time to time. The "Last updated" date at the top of this page will reflect when changes were made. The version in effect at the time of your purchase governs that transaction.
